1. Who you are contracting with
TradeSmith ("TradeSmith", "we", "us", "our") is operated by Andrew Anthony Nevinson, a sole trader established in the United Kingdom, trading as TradeSmith. By using TradeSmith you are entering into an agreement with Andrew Anthony Nevinson.

2. Acceptance of these terms
By creating an account, starting a free trial, subscribing, or otherwise continuing to use TradeSmith, you agree to these Terms & Conditions. If you do not agree, please stop using the service.
If you are using TradeSmith on behalf of a business, you confirm you have authority to bind that business. If you are using it as an individual, you confirm you are of legal age to enter a contract.
3. What TradeSmith provides
TradeSmith is a mobile-first customer relationship and job management tool for self-employed tradespeople and small trade businesses. It includes customer records, job scheduling, quoting, invoicing, expense and receipt capture, reporting, and an AI assistant that helps draft and organise this work.
We grant you a limited, non-exclusive, non-transferable right to use TradeSmith for your own trade business, within the limits of the plan you have selected.
4. Your account
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your login credentials confidential.
- You are responsible for all activity that happens under your account, including that of any team members you invite.
5. Acceptable use
You must not misuse TradeSmith. In particular, you must not:
- use the service for anything unlawful, fraudulent, or misleading;
- send spam, or use customer contact features to send unsolicited bulk messages;
- upload or generate content that infringes anyone else's intellectual property or privacy rights;
- interfere with the security or integrity of the service — including introducing malware, probing or scanning our systems, attempting to bypass access controls, or scraping data;
- reverse engineer, resell, redistribute or sublicense the service, or circumvent plan limits.
6. AI features
TradeSmith includes AI-assisted features (for example drafting quotes and invoices, breaking work down into labour and materials, reading receipts, and answering questions about your business data).
- AI outputs may be inaccurate or incomplete. They are suggestions, not professional, financial, tax or legal advice.
- You are responsible for reviewing and verifying anything produced by the AI before you send it to a customer or rely on it — including prices, totals, tax figures and job descriptions.
- You are responsible for the content you enter (prompts, notes, photos, receipts) and confirm you have the rights to submit it.
- We may refuse, filter or restrict outputs, and remove content or suspend accounts where use breaches these terms.
- You must not use the AI features to generate illegal content, impersonate others, or attempt to bypass safety restrictions.
If you believe content in TradeSmith infringes your rights, contact us at the email above and we will review and act, including removing content and terminating repeat infringers.
7. Intellectual property
We retain all ownership of TradeSmith and its intellectual property, including the software, documentation, design and branding. You retain ownership of your own business data and content (customers, jobs, quotes, invoices, documents and uploads). You grant us a limited licence to host and process that content solely so we can provide the service to you.
8. Payment, subscriptions and taxes
TradeSmith is sold on a monthly subscription, with a free trial period that does not require card details. Subscriptions renew automatically until cancelled.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, applicable taxes, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Our refund approach is set out in our Refund Policy.
9. Service level
We work hard to keep TradeSmith available and reliable, but we do not guarantee that the service will be uninterrupted, timely, secure or error-free. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. You are responsible for keeping your own records of business-critical documents.
10. Suspension and termination
We may suspend or terminate your access where:
- you materially breach these terms;
- payment is not made when due;
- there is a security, fraud or legal risk to us, our users or third parties;
- you repeatedly or seriously breach our acceptable use rules.
You may cancel at any time. On termination your access ends; you will have a reasonable window to export your data before it is deleted or anonymised in line with our Privacy Notice.
11. Liability
To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the service is limited to the fees you paid in the 12 months before the claim. We exclude liability for indirect, consequential or special losses, including loss of profits, revenue, data or goodwill. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be limited by law.
12. Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
13. General
- Governing law: the laws of England and Wales, with the courts of England and Wales having jurisdiction.
- Assignment: you may not assign these terms without our consent; we may assign them as part of a merger, acquisition or sale of the business.
- Force majeure: neither party is liable for delays caused by events beyond their reasonable control.
- Changes: we may update these terms; material changes will be notified in the app or by email.
